The regulation is clear that the daily limit for SMB is 10/day with no more than 1 over 14 inches. Those fish look larger than 14 inches to my eye. Having 3 such fish in the live well at one time is a clear violation of the daily bag limit. There is little doubt that holding fish for extended periods of time when water temperatures are warm or the fish have been caught deep (even if fizzed) decreases their chance of survival.
I guess it is up to each angler's ethic to decide whenever retaining (keeping in the live well) more than the daily bag limit or putting the fish at any increased risk of a mortality is worth that "stringer picture" that has become so popular in bass fishing circles.
Am certain that if two anglers were checked with 5 SMB over 14 inches in their live wells by an enforcement officer they would at least get a stern warning and in all likelyhood a ticket. After all how does the officer whether the angler intent to release the fish later.
